Terms & Conditions
These terms explain the rules that apply when you use the GoTime Athletics website, create an account, submit a request, purchase a product, or use an organization store.

Introduction
These Terms & Conditions constitute an agreement between you and GoTime Fitness, the business operating the GoTime Athletics brand.
In these Terms, “GoTime,” “we,” “us,” and “our” refer to GoTime Fitness in its operation of the GoTime Athletics website, online stores, products, forms, accounts, and customer-service systems.
“Website” refers to the GoTime Athletics website and its pages, stores, product listings, account tools, forms, checkout, and related services.
By accessing the Website, creating an account, submitting a form, or placing an order, you agree to these Terms and the policies incorporated into them. Do not use the Website or place an order when you do not agree to these Terms.
Store-specific, product-specific, quote-specific, or written terms may supplement these Terms. When a clearly disclosed store-specific or product-specific term conflicts with a general term below, the more specific disclosed term controls for that transaction.
1. Eligibility and authority
You must be legally able to enter into a binding agreement to place an order or authorize a business project.
A person under 18 should use the Website and place orders only with the involvement and permission of a parent or legal guardian.
When you place an order or submit a request on behalf of a school, team, club, business, nonprofit, church, or other organization, you represent that you have authority to provide the submitted information and request the applicable products or services.
Purchases intended for a child should be completed by a parent, guardian, or other authorized adult.
2. Permitted use of the Website
You may use the Website for lawful purposes, including:
- Reviewing products and organization stores
- Placing orders
- Managing a customer account
- Tracking an order
- Requesting a team store, custom apparel, fundraiser, or swim-team solution
- Contacting customer support
You may not:
- Attempt to gain unauthorized access to the Website, another customer’s account, an order, or administrative systems
- Interfere with the Website’s operation or security
- Use automated systems to scrape, copy, overload, or abuse the Website
- Submit false, fraudulent, misleading, infringing, defamatory, unlawful, or malicious content
- Use the Website to test stolen or unauthorized payment credentials
- Impersonate another person or organization
- Circumvent product, store, payment, geographic, or fulfillment restrictions
3. Customer accounts
Account creation is optional for most purchases because GoTime permits guest checkout.
When you create an account, you are responsible for:
- Providing accurate information
- Maintaining the confidentiality of your password
- Restricting access to your devices and account
- Promptly notifying GoTime of suspected unauthorized activity
You are responsible for activity occurring through your account unless applicable law provides otherwise.
GoTime may suspend or close an account reasonably believed to be involved in fraud, abuse, unauthorized access, repeated policy violations, or activity that threatens customers, GoTime, or the Website.
Guest orders are not automatically attached to a later-created account. Guest customers can use the Track an Order page with the order number and billing email.
4. Product information
GoTime makes reasonable efforts to provide accurate product names, descriptions, images, colors, materials, sizing information, prices, availability, and fulfillment details.
Actual colors may vary because of screen settings, photography, lighting, supplier variation, production processes, garment dye lots, and other factors.
Product measurements and size charts are guides rather than guarantees of fit. Fit may vary by brand, product style, cut, fabric, and customer preference.
Customers are responsible for reviewing the product description, size information, offered options, store deadline, fulfillment method, and product-specific policies before ordering.
5. Product availability and substitutions
Products, sizes, colors, materials, brands, and suppliers are subject to availability.
GoTime may remove an unavailable item, cancel an affected item, offer a reasonable alternative for approval, or refund the applicable amount.
GoTime will not make a material product substitution without communicating the proposed change when customer or organization approval is reasonably required.
An item appearing on the Website does not guarantee that it will remain available until checkout or fulfillment.
6. Organization and team stores
Each organization store may have its own:
- Opening and closing dates
- Approved product collection
- Artwork
- Pricing
- Sizing resources
- Personalization rules
- Fulfillment methods
- Production estimates
- Return and exchange terms
- Customer-support instructions
Store deadlines are firm unless the applicable store clearly states otherwise.
Late orders are not guaranteed. Availability, pricing, product options, and timing may differ after the original ordering period.
GoTime may close, extend, reopen, modify, or archive a store when required by the approved organization plan, product availability, production needs, or other operational circumstances.
A team, coach, school, club, or organization is not necessarily the seller of products merely because its name or branding appears on a GoTime store.
7. Custom, decorated, and personalized products
Custom, decorated, organization-branded, event-specific, made-to-order, and personalized products may have limited cancellation, change, return, or exchange rights.
Customers are responsible for reviewing submitted names, numbers, spelling, capitalization, size, color, and other selections before completing checkout.
An approved proof, mockup, product selection, or written confirmation may become binding once supplier ordering, artwork finalization, decoration, personalization, or production begins.
Applicable final-sale and exception terms are explained in the Refund & Returns Policy and any store-specific terms.
8. Customer-provided artwork, logos, and content
When you provide a logo, design, photograph, name, slogan, text, trademark, or other content, you represent that:
- You own it or have sufficient permission to use it.
- GoTime’s requested use will not violate another person’s rights.
- The submitted content is accurate and lawful.
You retain any ownership rights you have in customer-provided content.
You grant GoTime a limited, nonexclusive license to use, reproduce, resize, format, display, proof, transmit, and provide the content to approved service providers as reasonably necessary to:
- Evaluate the request
- Create proofs or mockups
- Build an organization store
- Produce approved merchandise
- Fulfill orders
- Provide customer support
GoTime may refuse content that appears unlawful, infringing, misleading, discriminatory, threatening, obscene, or inconsistent with GoTime’s business standards.
GoTime is not responsible for determining ownership disputes that are not reasonably apparent from the information provided.
9. Orders and order acceptance
Submitting an order is an offer to purchase the selected products under the displayed terms.
An automated order acknowledgement confirms that GoTime received the order; it does not prevent GoTime from reviewing the order for payment problems, availability, pricing errors, suspected fraud, prohibited content, incompatible fulfillment methods, or other issues.
GoTime may reject, limit, hold, or cancel an order when reasonably necessary, including when:
- Payment is declined or reversed.
- Product information or pricing contains a material error.
- A product is unavailable.
- The order appears fraudulent or abusive.
- Submitted artwork is unauthorized or unacceptable.
- The order conflicts with store-specific rules.
- Products in the cart have incompatible fulfillment requirements.
When GoTime cancels a paid item, GoTime will issue the applicable refund.
10. Pricing, taxes, and fees
Prices are shown in United States dollars unless stated otherwise.
Product prices may change before an order is placed.
Applicable taxes, shipping charges, approved restocking fees, personalization charges, setup costs, or other disclosed fees are added as shown before the customer completes the transaction.
Applicable New Mexico Gross Receipts Tax is separately stated during checkout.
When a pricing or calculation error is discovered, GoTime may contact the customer for approval of the corrected amount or cancel and refund the affected item.
11. Payment processing
Payments are processed through Stripe and the payment methods enabled at checkout.
By submitting payment information, you represent that you are authorized to use the selected payment method and authorize the applicable charge.
Payment authorization may be declined by Stripe, the card network, the issuing bank, or another payment provider.
GoTime may receive transaction identifiers, payment status, card brand, limited card details such as the last four digits, billing information, fraud signals, and related transaction information. GoTime does not ask customers to send complete payment-card numbers through contact forms or email.
Stripe’s own terms and privacy practices also apply to Stripe’s processing of payment information.
12. Shipping, pickup, and team distribution
The fulfillment methods available for an order are the methods displayed on the applicable product page, organization store, cart, or checkout.
Not every product qualifies for shipping, pickup, or team distribution.
Customers must review and comply with the applicable fulfillment instructions.
Shipping, pickup, delivery, and team-distribution terms are governed by the Shipping, Pickup & Team Distribution Policy.
13. Changes, cancellations, returns, and refunds
Order changes and cancellations are not guaranteed after supplier ordering, artwork approval, decoration, personalization, production, or fulfillment begins.
Return eligibility, final-sale products, issue-reporting periods, exchanges, restocking fees, return shipping, refund processing, and unclaimed pickup orders are governed by the Refund & Returns Policy.
14. Fundraising programs
Fundraising terms are established separately for each approved campaign.
GoTime does not guarantee:
- A particular sales total
- A particular fundraising amount
- A universal profit percentage
- A specific number of participants
- A particular campaign result
Results depend on participation, promotion, products, pricing, audience, campaign length, cancellations, returns, and other factors.
The applicable calculation, costs, exclusions, closeout method, and payment or account-credit terms will be disclosed before the campaign launches.
15. Promotions and discount codes
Promotions and discount codes may be subject to separate eligibility requirements, dates, product exclusions, order minimums, and other restrictions.
Promotions:
- Have no cash value.
- Cannot be applied retroactively unless GoTime approves otherwise.
- May not be combined unless expressly permitted.
- May be corrected, suspended, or withdrawn when affected by error, abuse, fraud, or legal requirements.
16. Intellectual property
The Website and its original text, layouts, graphics, software configurations, GoTime branding, component designs, documentation, and other GoTime-owned materials are protected by applicable intellectual-property laws.
You may use Website content for ordinary personal shopping and organization-review purposes.
You may not reproduce, publish, sell, license, reverse engineer, remove attribution from, or commercially exploit GoTime-owned Website content without written permission.
Third-party organization logos, product brands, photographs, and trademarks remain the property of their respective owners.
17. Third-party brands, services, and links
GoTime Athletics is an independent retailer and team-solutions provider.
Movement and other product brands carried by GoTime are independent brands unless a separate written statement expressly provides otherwise.
The Website may link to or use services operated by third parties, including payment providers, hosting providers, carriers, suppliers, and organization websites.
GoTime is not responsible for the independent content, security, availability, or privacy practices of a third-party website or service.
18. Website availability
GoTime may modify, suspend, restrict, or discontinue all or part of the Website for maintenance, security, updates, legal compliance, operational needs, or other reasons.
GoTime does not guarantee that the Website will always be uninterrupted, error-free, or compatible with every device or browser.
GoTime will use reasonable efforts to maintain reliable access and correct material errors.
19. Disclaimers
Except for express promises stated in these Terms, a product page, an organization store, an approved quote, or applicable law, the Website and its content are provided on an “as available” basis.
To the fullest extent permitted by law, GoTime disclaims implied warranties that may otherwise apply, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
This section does not eliminate:
- Express product warranties made by GoTime
- Rights arising from a confirmed GoTime error
- Manufacturer warranties that apply to a product
- Consumer rights that cannot legally be waived
20. Limitation of liability
To the fullest extent permitted by law, GoTime will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the Website, a delayed event, lost fundraising expectations, lost opportunity, or a customer’s failure to follow store instructions.
To the fullest extent permitted by law, GoTime’s aggregate liability for a claim arising from a particular product or order will not exceed the amount paid to GoTime for the affected product or order.
These limitations do not apply when prohibited by law and do not limit liability for fraud, willful misconduct, gross negligence, or another liability that cannot legally be limited.
21. Privacy
GoTime’s collection, use, disclosure, retention, and protection of personal information are described in the Privacy Policy.
22. Changes to these Terms
GoTime may update these Terms to reflect changes in the Website, services, technology, operations, policies, or applicable law.
The updated version will display a revised “Last updated” date.
Changes apply prospectively unless applicable law requires otherwise. The terms in effect when an order was placed generally govern that order, together with its product-specific and store-specific disclosures.
23. Governing law and venue
These Terms are governed by the laws of the State of New Mexico, without regard to conflict-of-law principles.
Any legal proceeding relating to these Terms or the Website must be brought in a court of competent jurisdiction serving Sandoval County, New Mexico, unless applicable law requires a different venue.
Nothing in this section prevents either party from pursuing a remedy available in small-claims court when the claim qualifies.
24. Severability and waiver
When a provision of these Terms is found unenforceable, the remaining provisions remain in effect to the extent legally permitted.
A failure to enforce a provision once does not waive the right to enforce it later.
25. Entire agreement
These Terms, together with the Privacy Policy, Refund & Returns Policy, Shipping & Delivery Policy, product information, organization-store terms, approved quotes, and other terms expressly incorporated into a transaction, constitute the applicable agreement between you and GoTime for that use or purchase.
